Indefinite Leave to Remain under Judicial Review

The Home Office has a current transitional arrangements in placed for those who an HSMP approval letter. Please read the following information:

1.      Application for an HSMP approval letter was made on or before 28 February 2008 – the Home Office will process your application. The applications will be decided in accordance with the immigration rules that were in place on 28 February 2008 even if the decision is reached after that date.

2.      Application for an HSMP approval letter was made in the United Kingdom on or after 29 February 2008 – the Home Office will not process the application and will be returned.

3.      Application for an HSMP approval letter was made in India on or before 31 March 2008 – the Home Office will process the application and this will be decided in accordance with the immigration rules that were in place on 31 March 2008 even if the decision is reached after that date.

4.      Application for an HSMP approval letter was from any country other than the United Kingdom or India and made on or before 29 June 2008 – the Home Office will process the application as normal and will be decided in accordance with the immigration rules that were in force on 29 June 2008 even if the decision is reached after that date.

5.      Application for an HSMP approval letter made on or after 30 June 2008 will not be processed by the Home Office and the application would be returned.
